1. Acceptance of Terms, Jurisdiction & Company Details

These Terms of Service constitute a legally binding agreement made between you and NON.agency United Kingdom, with its registered office at 20-22 Wenlock Road, N1 7GU London, United Kingdom (“we”, “us”, or “our”).

By accessing or using our application, you agree to be bound by these Terms of Service. These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

2. Age Restriction

You must be at least 18 years of age to use this service. By creating an account, you represent and warrant that you are 18 or older and legally capable of entering into a binding contract.

3. Service Provision & “As Is” Disclaimer

Our application provides an interface to generate text, images, video, and audio using third-party artificial intelligence models. The software is provided strictly on an “as is” and “as available” basis without any warranties, express or implied.

• We do not guarantee continuous, uninterrupted, or secure access to the application.
• We accept zero responsibility for any technical mistakes, system glitches, downtime, or functional disruptions within our software.

4. Content Generation & Acceptable Use

You agree to use the service strictly for lawful purposes. You may not use the application to generate content that is illegal, harmful, or malicious.

• Prohibited Content: We, alongside our third-party AI model providers, reserve the right to monitor prompts and strictly refuse the generation of content that violates safety guidelines. This includes, but is not limited to: explicit nudity, sexual content, gratuitous violence, self-harm, impersonation, hate speech, or the promotion/creation of illegal weapons.
• Enforcement: We reserve the right to terminate your account immediately, without warning or refund, for violating this Acceptable Use policy.

5. Liability, Quality, and AI Output Disclaimers

We provide the software interface; the content is generated by third-party AI models.

• We take no responsibility for the nature, accuracy, or legality of the generated content.
• We are not responsible for the quality of the outputs provided by the AI models.
• We do not guarantee that the generated output will adhere to your specific preferences, liking, or instructions. AI models operate unpredictably; you accept the content as it is generated.

6. User Responsibilities & Content Ownership

We do not claim ownership over the content you generate. To the extent permitted by law, you hold the rights to your generated output. However, you are solely responsible for how you use and publish it.

• Fact-Checking: AI is prone to hallucinations and factual errors. You are entirely responsible for verifying the accuracy of any generated output before use or publication.
• Copyright Compliance: You are strictly responsible for ensuring your generated content does not infringe on third-party copyrights, trademarks, or intellectual property rights. We accept zero liability for any copyright infringement or legal disputes arising from your use of the AI-generated content.

7. Account & Billing

Payments are processed securely via Stripe. You are responsible for maintaining the confidentiality of your account credentials.

8. Refund Policy

We enforce a strict refund policy based on your usage:

• Full Refunds: You are eligible for a full refund only if you have exclusively used the “10+1 free” tier and have not consumed any paid credits beyond the single free generation, or if you have made no payments at all. If you purchased credits but have strictly used zero of them, you may request a full refund.
• No Partial Refunds: We do not offer partial refunds for unused credits.
• Case-by-Case Review: If you have utilized any paid credits, we reserve the right to refuse a refund. Exceptions will be reviewed on a strict, case-by-case basis at our sole discretion.

9. Account Dormancy & Data Deletion

We will retain your generated content as long as your account remains active. If your account is inactive for a period of six (6) months, we reserve the right to permanently delete all associated generated content. We will notify you via email at least one (1) month prior to any data deletion due to inactivity.
